These Terms of Service ("Terms") govern your use of pictoflux.com and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Content Policy, which is incorporated into these Terms by reference.

1. Eligibility

You must be legally capable of entering into a binding agreement and must meet the minimum legal age in your jurisdiction. If you use the Service on behalf of an entity, you represent that you are authorized to bind that entity.

2. Accounts and Security

You are responsible for:

4. Content Policy and Safety

You must comply with our content safety requirements and Content Policy when using the Service. Prohibited or restricted content may include unlawful, exploitative, abusive, infringing, or otherwise harmful material. We may apply automated and manual safeguards, but moderation is not guaranteed to detect every issue.

The Service may include settings related to age-restricted content (18+) and NSFW visibility. These settings are user controls only and do not guarantee complete filtering or moderation outcomes. You are responsible for enabling, disabling, and using these settings appropriately.

5. User Content

You retain rights in content you submit ("Input"), subject to applicable law and third-party rights. You are solely responsible for your Input and for your use of generated outputs ("Output"), including legality, permissions, publication decisions, and downstream use.

6. AI Output Disclaimer

AI outputs may be inaccurate, incomplete, biased, offensive, or unsuitable for specific uses. Outputs may resemble existing works or content generated for other users. You must independently review and validate outputs before use.

7. Model Sources and Output Review

Our Service uses models from official providers, third-party services, and open-source projects. Moderation coverage is not guaranteed and may be absent for some models, including age-restricted content (18+) / NSFW scenarios. We do not guarantee content safety for every output. You are solely responsible for reviewing generated content before any use, sharing, or publication.

8. Intellectual Property

The Service, including software, interfaces, design assets, trademarks, and related materials, is owned by or licensed to us and protected by applicable laws. Except as expressly permitted, you may not copy, modify, reverse engineer, distribute, or create derivative works from the Service.

9. Payments, Credits, and Subscriptions

Paid plans, subscriptions, and credits (if offered) are subject to displayed pricing and billing terms at purchase time.

  1. Fees may change with notice as permitted by law.
  2. Credits may have usage limits, expiration rules, or plan-specific terms.
  3. Refunds are provided only where required by law or explicitly stated.

10. Third-Party Services

The Service may rely on third-party infrastructure or model providers. We are not responsible for outages, failures, policy changes, or acts/omissions of third-party providers.

11. Copyright, DMCA, and Repeat Infringer Policy

If you believe content on the Service infringes your copyright, you may submit a notice under the U.S. Digital Millennium Copyright Act (DMCA). A valid notice should include the information required by applicable law (including 17 U.S.C. § 512(c)(3)).

Where required by law, we may remove or disable access to allegedly infringing material and may take action against repeat infringers, including account suspension or termination.

12. Suspension and Termination

We may restrict, suspend, or terminate access at our discretion where necessary to protect users, the Service, legal compliance, operational security, or to enforce these Terms or the Content Policy. Upon termination, your right to use the Service ends immediately.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES ARISING FROM OR RELATED TO THE SERVICE.

15. Governing Law and Disputes

These Terms are governed by the applicable law in your jurisdiction, without regard to conflict-of-law principles. Disputes will be resolved through the courts or procedures required by applicable law in your jurisdiction unless otherwise agreed in writing.

16. Changes to Terms

We may update these Terms from time to time. Updated Terms become effective when posted unless stated otherwise. Continued use of the Service after effective date constitutes acceptance of updated Terms.
